Privacy Policy

What ClerkFees collects, why, who processes it, how long we keep it, and your rights.

This policy describes how Harper AI, Inc. (a Delaware corporation) handles personal information on ClerkFees. The short version: we collect little, we sell nothing, and every category below has a stated retention and a deletion path.

What we collect

  • Account email when you sign in (magic-link only; we never see or store a password).
  • Payment data is held by Stripe, our payment processor. We store subscription status and plan metadata, never card numbers.
  • Form submissions: waitlist signups and fee-correction reports (message and optional email).
  • Usage data via PostHog analytics: pages viewed, events, approximate location from IP, and, where enabled, session replays with all typed input masked.

Why we collect it

To operate accounts and subscriptions, to send the alerts and notifications you asked for, to answer correction reports, and to understand which pages and features are useful. We do not build advertising profiles.

Who processes it

Every third-party processor we use, by name and role:

  • Stripe: payment processing and subscription billing.
  • Resend: transactional email delivery (magic links, alerts, receipts).
  • PostHog: product analytics and error monitoring.
  • Google Cloud: application hosting and databases.

We do not sell or share personal information as those terms are defined under California law, and we have not done so in the preceding 12 months. There is no advertising use and no cross-context behavioral sharing.

Cookies, analytics, and session replay

We use a session cookie for sign-in and PostHog for analytics. Where session replay is enabled on marketing pages, everything you type is masked before it leaves your browser (PostHog’s maskAllInputs setting); replays exist to find broken pages, not to read input. Payment happens on Stripe’s hosted checkout, which we do not record.

Retention

  • Account data: for the life of the account, deleted on account deletion.
  • The counties you put on your fee book, and whether each one alerts you: for the life of the account, deleted on account deletion.
  • Waitlist signups: up to 2 years, deleted on request.
  • Consumer filing-packet answers: the packet product is not yet live; when it ships, packet answers will be encrypted at rest, kept up to 1 year after delivery, then purged, and deletable on request. This policy will be updated when that feature launches.
  • Payment records: retained by Stripe per its policies.
  • Subscription-consent records: at least 3 years (California automatic-renewal law).

Your rights

California residents have the right to know, delete, correct, and opt out of sale or sharing (we do not sell or share), and the right not to be discriminated against for exercising them. We extend the same requests to everyone: email privacy@clerkfees.com and we will act on verified requests within the statutory window.

Global Privacy Control and Do Not Track

We do not sell or share personal information. We still honor a Global Privacy Control signal automatically: when your browser sends GPC, we treat it as a decline for analytics and session replay on that visit (no banner, no capture), and when a request that identifies you by email carries GPC, we durably suppress that address from our non-essential outbound email. We treat DNT the same way.
